09/27/2011 Resolutions 2011-260RESOLUTION 2011-260 WHEREAS, a public utility easement is required by the City of Grand Island, from Iglesia De Dios Eben-Ezer to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including lines and transformers; and; WHEREAS, a public hearing was held on September 27, 2011, for the purpose of discussing the proposed acquisition of an easement located in Hall County, Nebraska; and more particularly described as follows: Commencing at the southwest corner of Smith Acres Subdivision, located in the City of Grand Island, Hall County, Nebraska; thence northerly along the westerly line of said Smith Acres Subdivision, a distance of thirty three (33.0) feet to a point on the northerly right-of-way line of Capital Avenue, being the ACTUAL Point of Beginning; thence continuing northerly along the westerly line of said Smith Acres Subdivision, a distance of ninety (90.0) feet; thence westerly, parallel with the northerly right-of-way line of said Capital Avenue, a distance of twenty five (25.0) feet; thence southerly and parallel with the westerly line of said Smith Acres Subdivision, a distance of ninety (90.0) feet to a point on the northerly right- of-way line of said Capital Avenue; thence easterly along the northerly right-of- way line of said Capital Avenue, a distance of twenty five (25.0) feet to the said Point of Beginning. The above-described easement and right-of-way containing a total of 0.052 acres, more or less, as shown on the plat dated 8/24/2011, marked E�ibit "A", attached hereto and incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Iglesia De Dios Eben-Ezer, on the above- described tract of land.
