04/10/2000 Resolutions 2000-SWA-1RESOLUTION 2000-SWA-1 WHEREAS, on August 10, 1992, by Ordinance No. 7850, the City of Grand Island approved the creation of the Grand Island Area Solid Waste Agency; and WHEREAS, the Grand Island Area Solid Waste Agency acquired and operates a solid waste disposal facility located approximately fifteen miles west of the City of Grand Island; and WHEREAS, Husker Highway, from the westerly boundary of the City to said solid waste disposal facility is used as a primary haul route for trucks transporting solid waste to the facility; and WHEREAS, a number of trucks transporting solid waste to the facility exceed the weight limits allowed by state law, causing excessive damage to the highway surface and road bed, substantially shortening the expected life of asphalt overlay projects, and increasing the cost of maintenance of and repairs to the Highway; and WHEREAS, on or about April 2, 1996, the parties entered into an Interlocal Agreement whereby the City and the Agency agreed to adopt a solid waste disposal service fee schedule in which a surcharge fee would be added to the regular service fee for any truck arriving at the facility weighing in excess of the amount permitted by Neb. Rev. Stat. §60-6,294, and further providing that accumulated surcharge fees collected be paid to the County to be utilized for repairs and maintenance of the Highway; and WHEREAS, it is the intent of the parties that the surcharge rate structure adopted by the parties be remedial in nature in order to compensate the County for damages caused to the Highway by overweight trucks utilizing the facility; and WHEREAS, the surcharge rate for overloads from 1 to 2,000 pounds has failed to accomplish the effect of deterring overloading trucks and appears to be a deterrent to haulers to deliver solid waste to the landfill; and WHEREAS, the Public Works Department, Solid Waste Division has proposed elimination of the surcharge rate for overloads from 1 to 2,000 pounds and replacement of said revenue to the County with quarterly payment of an amount equal to $0.09 per ton of solid waste received at the landfill during the previous quarter; and WHEREAS, the quarterly payments made to the County shall be utilized for repairs to and maintenance of Husker Highway; and WHEREAS, a revised Interlocal Agreement by and between the County of Hall, the City of Grand Island, and the Grand Island Area Solid Waste Agency has been reviewed and approved by the City Attorney and County Attorney, and adopted by the County of Hall. ~-- f-- Approved as to Form April 7, 2000 • City Attorney NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, sitting as the Grand Island Area Solid Waste Agency, that the revised Interlocal Agreement by and between the County of Hall, the City of Grand Island, and the Grand Island Area Solid Waste Agency dated February 8, 2000, is hereby approved; and the Chairman of the Grand Island Area Solid Waste Agency is hereby authorized and directed to sign such agreement on behalf of the Grand Island Area Solid Waste Agency.
