WHEREAS, a public utility easement is required by the City of Grand Island, from
Rudolf F. Plate and Jeannice R. Plate, husband and wife, and Tim C. Plate, a single person, to install,
upgrade, maintain and repair public utilities and appurtenances, including lines and transformers;
and
WHEREAS, a public hearing was held on June 26, 2007, for the purpose of
discussing the proposed acquisition of an easement located in a part of Lots Twenty Six (26) and
Twenty Seven (27), Westwood Park Tenth Subdivision in the City of Grand Island, Hall County,
Nebraska, the said Ten (10.0) foot wide easement being more particularly described as follows:
Beginning at the southeast corner of said Lot Twenty Six (26); thence running
northerly along the east line of said Lot Twenty Six (26); a distance of approximately
Twenty Five and Eight Hundredths (25.08) feet; to a point on the south line of an
existing Ten (10.0) foot wide utility easement; thence running westerly along the
south line of an existing Ten (10.0) foot wide utility easement, a distance of Ten
(10.0) feet; thence running southerly parallel with and Ten (10.0) feet west of the
east line of said Lot Twenty Six (26), a distance of approximately Twenty Five and
Eight Hundredths (25.08) feet, to a point on the north line of said Lot Twenty Seven
(27); thence continuing southerly parallel with and Ten (10.0) feet west of the east
line of said Lot Twenty Seven (27), a distance of Twenty (20.0) feet; thence running
easterly parallel with the north line of said Lot Twenty Seven (27), a distance of Ten
(10.0) feet, to a point on the east line of said Lot Twenty Seven (27); thence running
northerly along the east line of said Lot Twenty Seven (27), a distance of Twenty
(20.0) feet, to the point of beginning and containing 0.02 acres (901.6 Sq. Ft.) more
or less.
The above-described easement and right-of--way containing 0.02 acres (901.6 Sq.
Ft.), more or less, as shown on the plat dated April 26, 2007, marked Exhibit "A"
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Rudolf F. Plate and Jeannice R. Plate, husband
and wife, and Tim C. Plate, a single person, on the above-described tract of land.
