WHEREAS, a public utility easement is required by the City of Grand Island, from
Conagra Beef Company JBS USA, LLC, to survey, construct, inspect, maintain, repair, replace,
relocate, extend, remove, and operate thereon, public utilities and appurtenances, including lines and
transformers; and;
WHEREAS, a public hearing was held on March 22, 2011, for the purpose of
discussing the proposed acquisition of an easement located in the City of Grand Island, Hall County,
Nebraska; and more particularly described as follows:

Commencing at the southwest corner of Lot Sixty Three (63), Industrial Addition
to the City of Grand Island; thence northerly along the westerly line of said Lot
Sixty Three (63), a distance of one hundred thirty nine (139.0) to the ACTUAL
Point of Beginning; thence deflecting right 83'11'52" and running northeasterly, a
distance of four hundred nineteen (419.0) feet.
The above - described easement and right -of -way containing a total of 0.19 acres,
more or less, as shown on the plat dated 2/25/2011, marked Exhibit "A" attached
hereto and incorporated herein by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Conagra Beef Company JBS USA, LLC, on the
above - described tracts of land.
