WHEREAS, a public utility easement is required by the City of Grand Island, from
ALLEN PHASE III, LLC, A Nebraska Limited Liability Company, to install, upgrade, maintain, and
repair public utilities and appurtenances; and
WHEREAS, a public hearing was held on February 27, 2007, for the purpose of
discussing the proposed acquisition of an easement located in a part of Lot Thirteen (13)
Meadowlark West Fourth Subdivision, in the City of Grand Island, Hall County, Nebraska, being
more particularly described as follows:
The easterly ten (10.0) feet of the northerly two hundred six and forty three
hundredths feet (206.43') of Lot Thirteen (13), Meadowlark West Fourth
Subdivision, Grand Island, Hall County, Nebraska.

The above-described easement and right-of--way containing a total of 0.047 acres,
more or less, as shown on the plat dated February 13, 2007, marked Exhibit "A",
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from ALLEN PHASE III, LLC, A Nebraska Limited
Liability Company, on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, Febniary 27, 2007.
