10/24/2006 Resolutions 2006-322 I I RES 0 L UTI 0 N 2006-322 WHEREAS, public right-of-way is required by the City of Grand Island, from Ponderosa Lake Estates Subdivision Homeowners Association, Inc., to expand city utilities and street right-of-way; and WHEREAS, a public hearing was held on October 24, 2006, for the purpose of discussing the proposed acquisition of right-of-way along a tract of land consisting of part of Outlot "C4" of Ponderosa Lake Estates Subdivision in the City of Grand Island, located in the Southeast Quarter (SEl/4) of Section 36, Township 11 North, Range 10 West of the 6th p.m., Hall County, Nebraska and more particularly described as follows: Commencing at the Northeast Corner of Said SE1/4 of Section 36; thence on an assumed bearing of S88006'48"W along the North Line of said SE1I4 of Section 36 a distance of 118.70 feet to the point of intersection of said North line and the west right-of-way (R.O.W.) line of U.S. Highway #281; thence SOl028'17"E along said West R.O.W. line a distance of20.04 feet to the point of intersection of said West R.O.W. line and the North R.O.W. line of Rae Road; thence S88006' 51"W along said North R.O.W. line a distance of 260.15 feet to the point of intersection of said North R.O.W. line and the West R.O.W. line of James Road, said point also being the Northeast Corner of said Outlot "C4" and the point of beginning; thence S02004'52"E along the East line of said Outlot "C4" a distance of 29.96 feet; thence S88 006' 48" W a distance of 172.82 feet; thence N46053' 12"W a distance 01'28.28 feet; thence S88006'48"W a distance 01'625.24 feet to a point on the West line of said Outlot "C4", said West line also being the East line of Block 3 of said Ponderosa Lake Estates Subdivision; thence N01 054'06"W along said West line of Outlot "C4" a distance of 9.97 feet to the Northwest corner of said Outlot "C4"; thence N88 006'51"E along the North line of said Outlot "C4" a distance of 817.96 feet to the point of beginning. said tract contains 11,807 square feet or 0.27 acres more or less. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire public right-of-way from Ponderosa Lake Estates Subdivision Homeowners Association, Inc., on the above-described tract of land.
