WHEREAS, public right-of-way is required by the City of Grand Island, from Husker
Retail Development, LLC, a limited liability company, to expand city utilities and street right-of-
way; and
WHEREAS, a public hearing was held on October 24, 2006, for the purpose of
discussing the proposed acquisition of right-of-way along a tract of land consisting of part of Block
5, Ponderosa Lake Estates 4th Subdivision in the City of Grand Island, located in the Southeast
Quarter (SE1I4) of Section 36, Township 11 North, Range 10 West of the 6th P.M., Hall County,
Nebraska and more particularly described as follows:
Commencing at the Northeast Comer of said SEl/4 of Section 36; thence on an
assumed bearing of S88006' 48 "W along the North line of said SEl/4 of Section 36
a distance of 118.70 feet to the point of intersection of said North line and the West
right-of-way (R.O.W.) line of U.S. Highway #281; thence SOl 028'17"E along said
West R.O.W. line a distance of 40.04 feet to the point of intersection of said West
R.O.W. line and the South R.O.W. line of Rae Road, said point also being the
Northeast comer of said Block 5, Ponderosa Lake Estates 4th Subdivision and the
point of beginning; thence continuing SOl 028'45"E along said West R.O.W. line of
U . S. Highway #281 a distance of 9.96 feet; thence S88 006' 48 "W a distance of
199.86 feet to a point on the West line of said Block 5, said line also being the East
R.O.W. line of James Road; thence NOl 052'36"W along said east R.O.W. line a
distance of 9.94 feet to the point of intersection of said East R.O.W. line and the
South R.O.W. line of Rae Road, said point also being the Northwest comer of said
Block 5; thence N88006'29"E along said South R.O.W. line of Rae Road a
distance of 199.93 feet to the point of beginning. said tract contains 1,989 square
feet or 0.05 acres more or less.
NOW, THEREFORE, BE IT RESOL VED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire public right-of-way from Husker Retail Development, LLC, a limited liability
company, on the above-described tract of land.
