RESOLUTION 2006-271
WHEREAS, a public utility easement is required by the City of Grand Island, from
BM & M, LLC, a Limited Liability Company, to install, upgrade, maintain, and repair public
utilities and appurtenances; and
WHEREAS, a public hearing was held on September 26, 2006, for the purpose of
discussing the proposed acquisition of an easement located in part of Lot Eleven (11) Platte Valley
Industrial Park Third Subdivision, located in the city of Grand Island, Hall County, Nebraska, the
centerline of the twenty (20.0) foot wide utility easement and right-of-way being more particularly
described as follows:
Commencing at the Northeast comer of Lot Eleven (11) Platte Valley Industrial Park
Third Subdivision; thence southeasterly along the westerly line of said Lot Eleven
(11), a distance of fifty seen (57.0) feet to the ACTUAL Point of Beginning; thence
deflecting left 47016'33" and running in an easterly direction, a distance of one
hundred seventeen and ninety eight hundredths (117.98) feet; thence deflecting right
24047' 10" and running in a southeasterly direction, a distance of one hundred sixty
(160.0) feet. The sidelines of the above described easement tract shall be prolonged
or shortened as required to terminate on the boundary of Grantor's property.
The above described easement and right-of-way containing a total of 0.128 acres,
more or less, as shown on the plat dated September 6, 2006, marked Exhibit "A",
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from BM & M, LLC, a Limited Liability Company,
on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, September 26,2006.
