WHEREAS, a public utility easement is required by the City of Grand Island, from
Leland B. Dennhardt and Judy A. Dennhardt, husband and wife, to install, upgrade, maintain, and
repair public utilities and appurtenances; and
WHEREAS, a public hearing was held on September 26, 2006, for the purpose of
discussing the proposed acquisition of an easement located in part of the Northwest Quarter of the
Southwest Quarter (NW ~ SW 114), Section Twenty Four (24), Township Eleven (11) North, Range
Nine (9) West of the 6th P.M. in Hall County, Nebraska, the Westerly line of the ten (10.0) foot wide
utility easement and right-of-way being more particularly described as follows:
Commencing at the Northwest comer of the Northwest Quarter of the Southwest
Quarter (NW ~ SW ~), Section Twenty-Four (24), Township Eleven (11) North,
Range Nine (9) West; thence southerly along the westerly line of said Northwest
Quarter of the Southwest Quarter (NW 1/4 SW 114), Section Twenty four (24)
Township Eleven (11) North, Range Nine (9) West, a distance of four hundred ninety
five and twenty five hundredths (495.25) feet; thence easterly and perpendicular to
the westerly line of said Northwest Quarter of the Southwest Quarter (NW ~ SW ~)
Section Twenty Four (24), Township Eleven (11) North, Range Nine (9) West, a
distance of thirty three (33.0) feet to a point on the easterly right-of-way line of
Shady Bend Road, said point being the Actual Point of Beginning; thence southerly
along the easterly line of said Shady Bend Road, a distance of twenty (20.0) feet.
The above described easement and right-of-way containing a total of200 square feet,
more or less, as shown on the plat dated September 11,2006, marked Exhibit "A",
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Leland B. Dennhardt and Judy A. Dennhardt,
husband and wife, on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, September 26,2006.
