06/27/2006 Resolutions 2006-181 I I RES 0 L UTI 0 N 2006-181 WHEREAS, a public utility easement is required by the City of Grand Island, from Iglesia De Dios Eben-Ezer, a Nebraska non-profit corporation, to install, upgrade, maintain, and repair public utilities and appurtenances; and WHEREAS, a public hearing was held on June 27, 2006, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part ofthe West Half of the East Half of the West Half of the Southeast Quarter (Wl/2, El/2, Wl/2, SEl/4) of Section Four (4), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Beginning at the northeast comer of Lot One (1) Smith Acres Subdivision; thence northerly along the easterly line of the West Half of the East Half of the West Half of the Southeast Quarter (Wl/2, El/2, Wl/2, SEl/4) of Section Four (4), Township Eleven (11) North, Range Nine (9) West on an assumed bearing ofNOoo09'15"W, a distance of one thousand five hundred eighty six and forty nine hundredths (1,586.49) feet; thence N89000'06"W, a distance of ten (10.0) feet; thence SOoo09'15"E, a distance of five hundred sixty nine and forty nine hundredths (569.49) feet; thence N89000'06"W, a distance of ten (10.0) feet; thence SOoo09' 15 "E, a distance of twenty (20.0) feet; thence S89000'06"E, a distance often (10.0) feet; thence SOoo09'15"E, a distance of nine hundred ninety seven (997.0) feet to the northerly line of said Lot One (1) Smith Acres Subdivision; thence easterly along the northerly line of said Lot One (1) Smith acres Subdivision, a distance of one hundred sixty seven and seventy two hundredths (167.72) feet to the said point of beginning. The above-described easement and right-of-way containing 0.369 acres, more or less, as shown on the plat dated June 8, 2006, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Iglesia De Dios Eben-Ezer, a Nebraska non- profit corporation, on the above-described tract of land.
